It commemorates Mer Island man Eddie Koiki Mabo and his successful efforts to overturn the legal fiction of terra nullius or land belonging to no-one.

As we know the Australian Government has claimed that no-one had ownership of the country prior to its colonisation in 1788. In 2009 as part of the Q150 celebrations the Mabo. In the Torres Strait its a public holiday and in the rest of Australia its a chance to remember a man who had a big impact on Australias history.
29 June 193621 January 1992 a Torres Strait Islander man whose campaign for Indigenous land rights in Australia led to the courts decision which overturned the legal fiction of terra nullius that had characterised Australian law with regard to land and title since the voyage of James Cook in 1770. But every year when National Reconciliation Week ends and June 3rd approaches Indigenous People prepare to celebrate Mabo Day and the long overdue recognition that was finally paid to them. The Mabo Case was successful in overturning the myth that at the time of colonisation Australia was terra nullius.
The Mabo Case was a significant legal case in Australia that recognised the land rights of the Meriam people traditional owners of the Murray Islands which include the islands of Mer Dauer and Waier in the Torres Strait. Mabo Day is commemorated on the final day of Reconciliation Week which kicks off after Sorry Day. This decision is celebrated every year on June 3 as Mabo Day.

The Torres Strait islands lie in a navigable channel between the tip of Cape York in Queensland and the southern coast of the island of New Guinea. It commemorates Eddie Koiki Mabo c. Together they challenged the authority of the Queensland government to claim not just sovereignty but also ownership of the land comprising their ancestral home.
